Terms of Service

1. License Type
By purchasing a beat lease from Damn Jay, the artist is granted a non‑exclusive, non‑transferable license to use the instrumental for their music project.
Multiple artists may lease and use the same beat unless exclusive rights are later approved and purchased.
Artists who wish to obtain exclusive rights must review Section 12 — Exclusive Rights Eligibility, which explains the requirements (such as 750,000+ streams or major‑label/publisher/management backing).

When Exclusive Rights Are Sold
If exclusive rights are approved and purchased:

•     The beat is immediately removed from the website
•     No new leases will be sold
•     All existing leases remain valid, and those artists may continue using the beat under the terms they originally purchased
•     The exclusive buyer becomes the sole future owner of the beat, but this does not retroactively cancel or override any previously issued leases
Exclusive ownership does not cancel Damn Jay’s 40% producer royalty share, which remains permanent and must be honored on all releases.

2. What You Are Allowed To Do

With a standard lease, you may:

  • Record vocals over the beat

  • Release your song on streaming platforms

  • Monetize your release

  • Perform the song live

  • Use the beat in music videos, promos, and social media content

3. What You Are NOT Allowed To Do
You may not:
•     Claim production credit
•     Resell, redistribute, or upload the beat as an instrumental
•     Transfer the beat to another artist
•     Upload the beat to Content ID or fingerprinting systems
•     Upload the beat to any platform as your own production
Unauthorized redistribution or resale will result in liability for the full production value of $1,500, plus any additional damages allowed by law.

4. Credit Requirement
All releases using leased beats must credit:
“Prod. by Damn Jay”
This credit must appear in all streaming platform metadata, video descriptions, and promotional materials.

5. Delivery
All beats are delivered digitally.
No physical products are shipped.

6. Refund Policy
All purchases are final.
Because digital files cannot be returned, no refunds will be issued under any circumstance.

7. One‑Time Fee Policy (No Stream Caps)
Damn Jay does not charge renewal fees based on streaming numbers.
There are no 100k, 500k, or 1M stream thresholds that require additional payment.
Once you lease a beat, you pay one single fee — no renewals, no hidden charges.

8. Mandatory Royalty Splits

All artists who release music using a leased beat must add Damn Jay to the royalty splits during the distribution process.

Required Split Information:

  • Producer Name: Damn Jay

  • Email: info@damnjay.com

  • Producer Share: 40% of the master recording revenue

This split MUST be added before the song is released.

9. Breach of Split Requirement
If the artist releases the song without adding the required 40% producer split, they are in breach of this license agreement.
Damn Jay reserves the right to pursue:
•     Retroactive royalties
•     Publishing corrections
•     Damages for breach
•     Industry‑standard producer compensation (commonly up to 50% of the master share)
•     Any additional compensation allowed under applicable law
This applies especially if the song becomes commercially successful.

10. Upgrades
You may upgrade from a lease to exclusive rights only if the beat is still available.
Exclusive rights remove the beat from future leasing.

11. Legal Enforcement
Any violation of these terms may result in:
•     Takedown notices
•     Copyright claims
•     Legal action
•     Financial liability for damages

By purchasing a lease, you agree to all terms listed above.

12. Exclusive Rights Eligibility

Damn Jay does not offer exclusive rights by default.
Exclusive rights will only be considered for artists who meet one or more of the following conditions:

A. Performance‑Based Eligibility

The artist has:

  • Released a leased version of the beat

  • Achieved 750,000+ streams across major platforms

  • Demonstrated significant traction, momentum, or virality

  • Shown clear evidence of audience growth and commercial potential

B. Industry‑Backed Eligibility

The artist has been:

  • Signed by a major record label

  • Signed by a major music publisher

  • Signed or represented by a major management team that handles established or high‑profile artists

13. Exclusive Rights Ownership

If exclusive rights are approved and purchased:

  • The artist becomes the exclusive owner of the beat

  • The beat is removed from all leasing and future sales

  • No other artist will be allowed to use or lease the beat

However, exclusive ownership does NOT cancel Damn Jay’s royalty share.

14. Producer Royalty Share (Even With Exclusives)

Even when exclusive rights are sold, Damn Jay retains:

  • 40% of the master recording revenue

  • Mandatory producer credit: “Prod. by Damn Jay”

This royalty share is permanent, non‑negotiable, and must be added during the release process.

Exclusive rights give the artist ownership of the beat —
not ownership of your royalties.

15. Exclusive Rights Pricing

If exclusive rights are approved, pricing will be determined based on:

  • The song’s performance

  • Market value

  • Commercial potential

  • Industry backing

  • Demand for the beat
